Contracting out – Self Invested Personal Persons

From 1 October 2008 a change in legislation will allow Self Invested Personal Pensions (SIPPS) to hold Protected Rights. Schemes wishing to hold Protected Rights will need to hold a valid contracting-out certificate.

Such schemes can apply for a contracting out certificate prior to the legislation coming into force, the application should request an effective date of contracting-out of 1 October 2008. Applications for contracting out certificates should be made to HM Revenue & Customs using form APSS101. Before completing the APSS101 you should refer to our CA16A Manual (PDF 207K) which provides guidance on contracting out and also to the APSS101 completion notes.

Note: The guidance and the form APSS101 is in the process of being amended to reflect the changes in the legislation, however, in the meantime the current form should be used.
